USCIS Improves Due Process Review Process for Cubans, Nicaraguans, and Venezuelans

The United States government currently authorizes up to 30,000 people each month to come to the United States for temporary residency under a case-by-case process for Cubans, Haitians, Nicaraguans, and Venezuelans. Due to high interest in these processes, USCIS has updated the review process effective May 17, 2023.

Because the number of sponsors filing Form I-134A, the online application, and the Notice of Financial Support significantly exceeds the 30,000 travel authorizations available monthly, we have updated this process. This is to maintain a significant and equal opportunity for all beneficiaries of Form I-134A to progress through the process and apply for advance travel authorization.

Under the new review process, which took effect May 17, USCIS will randomly select half of the monthly total, regardless of the filing date of all pending Forms I-134A, to determine whether the case can be certified. The other half of the monthly total of Forms I-134A will be reviewed in order of receipt based on the filing date of the case, with older Form I-134A being prioritized for review.

Potential sponsors may not file a duplicate Form I-134A for the same beneficiary. We will not accept a duplicate Form I-134A unless a previously filed Form I-134A is pending between the same potential sponsor and the beneficiary. If USCIS does not confirm the Form I-134A, and a supported person meets the requirements to be a sponsor under the process, that person may file a new Form I-134A and submit additional information as evidence.
