What Every Oklahoman Should Know About Insurance Claim Disputes

Consumers across Oklahoma are being encouraged to take a more proactive approach to understanding their insurance policies as disputes over claims continue to create financial and emotional pressure for households dealing with unexpected losses.

In a public advisory issued by Oklahoma Insurance Commissioner Glen Mulready, residents were reminded that preparation, documentation and a clear understanding of policy terms can significantly reduce the likelihood of disputes arising during the claims process.

The guidance from the Oklahoma Insurance Department comes as homeowners and policyholders increasingly face complex claims following storm damage, property losses and other insured events. The department said misunderstandings about coverage remain one of the leading causes of disagreements between insurers and consumers.

Mulready said many disputes can be avoided if policyholders regularly review the details of their insurance contracts and understand exactly what is and is not covered.

“No matter the insurance type, filing an insurance claim can be stressful. When issues arise or your claim gets denied, that stress can compound. There is no need to worry! I want to share with you some advice and resources available through the Oklahoma Insurance Department (OID),” Mulready said.

Policy Understanding Seen as Key to Avoiding Disputes

The commissioner stressed that consumers should familiarise themselves with policy deductibles, exclusions, endorsements and coverage limits before a claim is ever filed.

“My biggest piece of advice to help avoid issues or denials is to know your policy. Often, disputes originate from misunderstandings about coverage. I recommend reviewing your policy with your agent regularly and asking any questions about your coverage or whether you have any gaps,” Mulready said.

Insurance experts have long warned that policyholders frequently overlook exclusions or limitations embedded within contracts, only discovering them after submitting claims. The department advised residents to keep both physical and digital copies of their policies to ensure documents remain accessible during emergencies.

The advisory also highlighted the importance of maintaining accurate records and evidence throughout the claims process, particularly for homeowners affected by severe weather incidents.

“When filing a claim, document everything. For example, if you are filing a homeowners claim for storm damage, take plenty of pictures and videos of the damage. Have your home inventory readily available to show exactly which belongings need to be replaced. Keep a record of all communications with your insurance company,” Mulready said.

The commissioner added that filing claims promptly can help speed up assessments and reduce the risk of delays or complications.

Consumers Encouraged to Challenge Unclear Denials

The Oklahoma Insurance Department also warned consumers not to assume a rejected claim is necessarily the final outcome.

“It’s important to understand that claims denials are not always final. Review them carefully. Seek explanations in writing from your insurer. Some common reasons for denials include policy exclusions, missed deadlines and incomplete information,” Mulready said.

The department advised policyholders to compare denial letters directly against the wording contained in their insurance contracts and seek clarification whenever terms or decisions appear unclear.

Consumer advocacy groups in the United States have increasingly called for greater transparency around claims handling, particularly after natural disasters and large-scale weather events that generate high claim volumes.

According to the Oklahoma Insurance Department, residents who believe a claim has been improperly denied can request assistance through the agency’s Consumer Assistance Division.

“If you believe your claim was incorrectly denied, free help is available through OID’s Consumer Assistance Division. Our team can review consumer complaints, communicate with insurers, and ensure outcomes comply with Oklahoma law and your insurance contract,” Mulready said.

Mediation Process Offered as Alternative to Litigation

Where disputes cannot be resolved through the standard complaint process, the department said mediation may provide an alternative to costly legal proceedings.

The programme, known as EAGLE — short for Ending Arguments Gently, Legally and Economically — enables both parties to attempt a negotiated settlement with the assistance of a mediator.

“If we are unable to resolve the matter through the complaint process, EAGLE (Ending Arguments Gently, Legally and Economically) mediation could be an option,” Mulready said.

Under the process, both sides must agree to mediation before sessions are scheduled. If no agreement is reached, both parties retain the right to pursue litigation independently.

Mulready concluded by urging residents to remain organised and informed throughout the insurance process.

“Issues that arise when filing an insurance claim can add to an already stressful situation. Preparation and knowledge, though, are your best tools. Review your policies regularly, stay organized and reach out for assistance when needed. OID is always here to help!” he said.
