Faced with such challenges, we believed it appropriate to inaugurate a knowledge space within the ECAE, whose characteristics reach the collective, the multiple and the interdisciplinarity as a platform from which to build tools that are useful to those who face daily, on the one hand , with the need to advise on new matters and, on the other hand, the need to create new strategies for the defense of the State.
The priority lines of research are: National Thought. Regulatory Capacity of the State and Public Services; Economic, Social, and Environmental Rights; and Public Debt: Legal, historical and economic aspects. From the Research Area we open the call to join one of the three Permanent Seminars (SP) that will develop research on strategic issues, each crossed by the perspective of gender and diversity and human rights.
These spaces are set up to promote critical and interdisciplinary dialogue between exhibitors and attendees, with the following objectives:
a) Produce knowledge and promote research on issues of relevance to the practice of public law;
b) Stimulate exchanges between academic knowledge and professional practice;
c) Encourage dialogue between scientific fields and disciplines and the recognition of various types of knowledge and forms of knowledge;
d) Promote innovative research on the strategic axes of this call
e) Facilitate articulations with organisms of the National Public Administration.
The SP were integrated with the people selected in the call made during the first months of this year, and in the month of April the activities of each of the SP began, which included presentations by experts in each of the lines of research mentioned. . There is also a virtual library, where materials and resources are periodically added by researchers, the Area and those who make the exhibitions. We also have the space of the ECAE Journal for the dissemination of the researchers’ work to the entire spectrum reached by that publication.
So far, we have debated and discussed the challenges faced by the National Public Administration (APN) from multiple perspectives. In this sense, we can mention the conference given by Dr. Ana Castellani identifying the axes of transformation of the public function during the pandemic; the first axis, relative to the accessibility of the services provided by the State, the procedures and access to public policies; the second axis on the need for innovation and quality of management; the next axis on the comprehensiveness required by public employment policies; a fourth axis that covers transparency and public ethics; and finally the transformation of certain practices to achieve greater active participation and federalization on crucial issues at the national and local level.
To subscribe to this line proposed by Dr. Castellani, we invited Dr. Ariel Vercelli who prepared a detailed presentation on the need to create new management technologies for the APN, the lights and shadows of artificial intelligences and their relationship with the need to create new legal tools
We also have the invaluable experience of Mr. Eduardo Salas, who fostered fruitful discussions related to public employment, from a historical perspective that opened up new questions regarding the abrupt and unexpected changes in work in our homes and how this had an impact, not only at the regulatory level. but on a professional level. These conferences have allowed us to give an account of the changes, the emergencies that the APN faces during the pandemic and the formal, material and epistemological effects that are derived.
Also, discussions have been held in the field of Economic, Social, Cultural and Environmental Rights with the participation of Dr. Matías Scunza who, by way of inauguration, raised the need to understand all this set of rights from an integrated perspective that allows building a new rationality that leads to a conceptual resignification that calls into question an individualistic idea of access and guarantee of human rights, recovering the experiences of groups in the territories and the consequences that said rationality has in the forms of the State and democracy
For her part, Dr. Erica Bauger proposed the discussion, based on the “Ruiz” Judgment, of the human rights of indigenous peoples from a dialogic and intercultural conception of human rights and a critical perspective against Euro-centered legal feminisms, tools that ultimately allow the construction of genealogies from the South that account for the clashes that occur between the right to self-determination of peoples and the realities of heterodetermination
Dr. Federico DeFazio, in another of the meetings, gave a conference that detailed the different theoretical approaches to research in the field of social rights. From the presentation of the developments of his doctoral thesis, he listed the different approaches among which are the theory of justice, the history of law, the sociology of law, the theory of political legitimacy and the theory of decision. judicial, which address the guarantee and enjoyment of constitutional social rights.
Faced with such a pressing issue for the Argentine reality for several decades, the Public Debt SP had presentations by Dr. Sebastían Soler, Deputy Treasury Attorney, who addressed the central legal aspects of public debt; In a second meeting, Dr. Noemí Brenta historicized the relations between the Argentine Republic and the IMF between 1956 and 2021, providing essential tools to understand what this credit organization is and how it works, the different edges of the successive agreements signed with our country and the current situation in Argentina
Anyone who has been trained in legal science and law notices the training deficits to carry out research in this area. For this reason, each of the SP houses a Research Clinic designed as a space for researchers to design their projects, share the advances they make and exchange knowledge with other members, so that all research is oriented to produce knowledge that can be immediately used by the APN or by other institutions in the face of current and future challenges.
