But what does Peru’s constitution say about this? The text of the Constitution gives the President the power to dissolve Congress, but only in certain cases.

According to the consensus of constitutional analysts in the country, Castillo’s decision to dissolve Congress was considered unconstitutional.

Article 134 empowers the President to dissolve the Congress “if it censures or disapproves of two committees of ministers”, something that does not happen in the country.

For example, on November 11, the Peruvian Congress refused to answer a confidence question requested by the executive. days later, Castillo accepted the resignation of Anibal Torres, the head of the Council of Ministers.

The official submitted his resignation after the congress’s board of directors agreed by a majority to “completely reject” the question of confidence raised by the official to change the rule governing the call for a referendum. Jose Williams, head of the legislative branch, explained at the time that the question of trust was not presented by statute, but with the “restricted matters of access” to such a mechanism.

Even if the legality of this demand for confidence is debatable, a second censure or congressional denial of confidence, absent the cabinet, is something that did not happen, and it puts Castillo’s decision to dissolve the legislature. Illegal domain.
