Peru judge upholds Evo Morales' entry ban

(Cnn in Spanish) —The Second Constitutional Chamber of Lima's High Court approved the decision of the National Immigration Monitor to ban former Bolivian President Evo Morales from entering Peru, according to a judicial resolution of the case obtained by CNN. supervision.

Morales' entry ban into Peru was imposed on January 6, 2023. Dissatisfied with the move, Morales' lawyers filed a lawsuit that Lima's Fifth Constitutional Court declared partially established last November. Freedom may be affected. However, the case was transferred to the High Court.

In this new resolution – dated January 30 – the Second Constitutional Chamber concludes that the monitoring functioned in accordance with Peru's legal framework.

“The decision declaring the ban on entry to Peru on Mr. Juan Evo Morales Ayma, given on January 6, 2023, we clearly see that the actions of migration are not arbitrary as much as they are based on administrative. The summary sent by the General Directorate of Intelligence of the Ministry of Interior (pages 97 to 173), in which “Mr. Morales is a promoter of Ayma and a participant in ideological and political events to disrupt internal order and counter actions by the Peruvian government,” the document says.

“The decision taken by Migrations is completely justified, because it seems from the intelligence service that Mr. Morales Ayma has already been classified as a dangerous person for the security of the state, and that is the main reason. As the plaintiff and the court wrongly state, they should be denied entry into our territory and thereby rejected as not motivated,” he insists. .

CNN is attempting to reach former President Morales or his legal team for comment.

The December 7, 2022 impeachment and arrest of President Pedro Castillo, who attempted to unconstitutionally dissolve Congress, was followed by protests and demonstrations that left dozens dead in many parts of the country, particularly in the south.

After Castillo's departure, several Peruvian congressmen accused Morales, one of the staunchest critics of Castillo's successor, Tina Polwart, of being behind the protests.

In November 2021, before Castillo's departure, the Foreign Relations Commission of the Peruvian Congress approved by a majority a report declaring Morales ineligible for the presidency to intervene in the country's internal affairs.
