An appeals judge rejects Sam Bankman-Fred’s request for immediate release from prison

Sam Bankman Fried The former FTX CEO has lost his initial bail appeal again ahead of his criminal trial.

In a suit dated September 6 in the United States Court of Appeals for the Second Circuit, Court clerk Kathryn O’Hagan Wolf reported that the circuit judge denied a motion by Bankman Fried’s legal team requesting his immediate release from the Metropolitan Detention Center in Brooklyn. Lawyers for the former FTX CEO have petitioned the court to release him temporarily, arguing that current procedures intended to allow Bankman-Fried to help prepare his defense at trial were insufficient due in part to limited internet access.

“The request for provisional release is sent to the next available three-judge panel,” Wolf said. “As far as the appellant requests his immediate release pending a decision by the panel of three judges, this request is rejected.”

After being extradited from the Bahamas and appearing in a US court in December 2022, Bankman-Fried was released on $250 million bail and held largely in his parents’ home in California.. However, a federal judge canceled her bail on Aug. 11 following accusations of witness intimidation against Caroline Ellison, the former CEO of Alameda Research, with whom Bankman-Fred had a personal and professional relationship.

Bankman-Fried’s attorneys made several motions after the judge’s bail order, requesting that the SBF be allowed more time to review evidence in the Brooklyn jail visiting room and in the counsel’s room at the New York courthouse. sufficient notice to the court. The former FTX CEO has nearly four weeks before his trial begins on Oct. 3.
